PhoneMann is a trading style of ONSIM LTD, a company registered in England & Wales (No. 08429703). Registered office: 86-90 Paul Street, London, EC2A 4NE. “We”, “us” and “our” mean ONSIM LTD; “you” and “your” mean the customer.
Please read these Terms of Service (“Terms”) carefully. By signing up for or using PhoneMann (the “Service”) you agree to be bound by these Terms. If you do not agree, please do not use the Service.
The Service
PhoneMann provides you with a local UK telephone number (your “PhoneMann Number”) that forwards calls to a single Isle of Man number of your choice (a Manx landline beginning 01624, or a Manx mobile beginning 07624). When you dial your PhoneMann Number from your own phone, we connect the call on to that Isle of Man number over our network.
One PhoneMann Number is required for each Isle of Man number you wish to call. You may change the Isle of Man number your PhoneMann Number forwards to at any time from your online account.
The Service is a call-routing service. It is not a replacement for your telephone line and cannot be used to call emergency services (999/112). Always use your normal phone and network for emergency calls.
Pricing, credit and billing
The Service is pay as you go and prepaid. You add credit to your account (top up) and the cost of your calls is deducted from that credit.
- Calls to Isle of Man landlines are charged at 3p per minute; calls to Isle of Man mobiles at 6p per minute.
- A service charge of £1 per month is taken from your credit to keep your PhoneMann Number active.
- All prices include VAT at the prevailing UK rate (currently 20%).
- Top-ups start from £10. Call charges are calculated per second and shown in your account.
We may change our prices or this service charge. Where a change is material we will give you reasonable notice (for example by email or in your account) before it takes effect.
Your credit is a prepaid balance held against your use of the Service. It is not electronic money, a deposit, or a bank balance, earns no interest, and may only be used for the Service. Credit is non-refundable, including any balance remaining when your account is closed.
Auto top-up
You may choose to enable auto top-up, which authorises us to charge your saved payment card automatically when your balance falls below the level you set, to keep your Service running. You can change or switch off auto top-up, or remove your card, at any time in your account. Disabling auto top-up does not close your account.
Your number
Your PhoneMann Number is provided to you for use with the Service and remains under our control. You do not own the number and may not sell or transfer it. If your account is closed or your credit runs out (see Termination), the number is released and may be reassigned.
Acceptable use
The Service is intended for personal use by individuals and is subject to fair use. You must not use the Service:
- for commercial purposes, resale, call-centre, auto-dialling, or to generate artificial traffic;
- for unlawful, fraudulent, abusive, harassing or nuisance purposes; or
- in any way that disrupts the Service or our network.
If we reasonably believe you are breaching this section we may limit, suspend or terminate your account.
Cancellation and your right to cancel
You can close your account yourself at any time from your dashboard. On closure your PhoneMann Number stops working immediately and is released, and any remaining credit is non-refundable.
For consumers, you have a statutory right to cancel within 14 days of signing up. However, because the Service (including provisioning your number) begins immediately at your request, by signing up you ask us to begin straight away and acknowledge that once the Service has been fully provided you lose the right to cancel, and that if you cancel during the 14-day period after use has begun you may be charged for the Service provided up to that point. Prepaid credit used for calls and the service charge is non-refundable.
Suspension and termination by us
We may suspend or terminate your account, with or without notice, if your credit is insufficient to cover the service charge or your usage, if you breach these Terms, or where we are required to do so. If your balance is insufficient to cover the monthly service charge, your Service may be suspended and, if not resolved, your account closed and your number released.
Service availability and liability
We aim to provide a reliable Service but do not guarantee it will be uninterrupted or error-free, and it is provided “as is”. Call quality and connectivity depend on networks outside our control. To the fullest extent permitted by law, we are not liable for any loss arising from your inability to make a call, for call quality, or for any indirect or consequential loss. Nothing in these Terms limits liability that cannot be limited by law (including for death or personal injury caused by our negligence, or fraud). Where we are liable, our total liability is limited to the credit on your account at the time the claim arises.
Privacy
We take your privacy seriously and handle your personal data in accordance with UK data protection law and our Privacy Policy. We do not sell your data, and only share it where necessary to provide the Service (for example with our network and payment partners) or where legally required.
Changes to these Terms
We may update these Terms from time to time. Where a change is material we will give reasonable notice. Continuing to use the Service after changes take effect means you accept the updated Terms.
Governing law
These Terms are governed by the laws of England and Wales, and the courts of England and Wales have non-exclusive jurisdiction. If any provision is found unenforceable, the remaining provisions continue in effect.
